New Build Conveyancing for Buyers

New build conveyancing follows a similar legal process to a standard purchase, but with tighter timelines and a few extra considerations along the way. Here’s what to expect.

Reservation & Instruction

You pay your reservation fee to secure the plot and instruct us straight away; time is of the essence from this point. We carry out ID checks, review your reservation agreement, and get to work on the contract pack without delay. The clock is ticking from day one.

2.

Contract Review & Negotiation

We review the contract pack from the developer’s solicitors. New build contracts are both detailed and weighted in the developer’s favour, so we’ll go through everything carefully, raise any concerns, and negotiate any amendments before you commit.

3.

Searches & Enquiries

We carry out the necessary searches and raise enquiries with the developer’s solicitors. On a new build, some searches may need to be repeated closer to completion if there’s a significant gap between exchange and your anticipated completion date.

4.

Exchange of Contracts

Once we’re satisfied with the contract, and your mortgage offer is in place, we exchange. On new builds this often happens before the property is finished; you’ll usually need to exchange within a set timeframe from reservation, with a set completion or longstop date agreed in the contract.

5.

Pre-Completion & Snagging

As build nears completion, we’ll be in touch to make sure everything is ready on the legal side. This is also the time to arrange an independent snagging survey if you want one — identifying any defects before you legally complete gives you the strongest possible position when raising them with the developer.

6.

Completion & Key Collection

On completion day we transfer your funds to the developer’s solicitors, and you collect your keys. We’ll then handle post-completion registration of your title and mortgage with the Land Registry. Now the property is officially yours.

Speed and complexity, mainly. Developers typically require exchange within 28 days of reservation, which is much faster than a standard purchase. Contracts are more detailed, build delays can affect mortgage offer validity, and there are additional considerations around snagging and completion notices. Experience matters, and it’s worth instructing solicitors who know the process well.

A payment made to the developer to secure your plot while the legal work is completed: typically between £500 and £2,000, usually deducted from your purchase price on completion. This fee is not always fully refundable if you withdraw, so understanding the terms before you pay is important. We’ll review your reservation agreement at the outset and flag anything relevant.

Delays are common and can put your mortgage offer at risk should it expire before your new completion date. We monitor your timeline closely and liaise with your lender if an extension becomes necessary. Your contract should also include a longstop date — the latest the developer can complete — and we’ll make sure you understand your rights if it’s missed.

A record of defects or unfinished items in your new build, such as poorly fitted doors, incomplete decoration, and minor structural issues. You can raise snags after completion, but identifying them beforehand gives you more leverage with the developer.
